Terms & Conditions
1. GENERAL TERMS
1.1 These Terms & Conditions apply to all sales made at Dwellings Group (“Dwellings”) operated stores and online platforms in Barbados, including Dwellings Home, Mindful Market, Ashley Furniture Homestore, and Liliplum Kids. By making a purchase from Dwellings, you acknowledge and agree to these terms.
1.2 Dwellings is committed to upholding consumer rights and ensuring that all goods and services meet expected standards of quality and functionality.
2. PRODUCT INFORMATION
2.1 Dwellings strives to provide accurate and detailed product information, including dimensions, materials, and features. However, slight variations in colour, texture, and appearance may occur due to natural material differences and screen display limitations.
3. PRICING & PAYMENT
3.1 All prices are listed in Barbados Dollars (“BD$”) unless otherwise stated and include applicable taxes. Prices are subject to change without prior notice.
3.2 Full payment is required at the time of purchase unless otherwise agreed upon in writing.
3.3 For online payments made with an international credit card, Dwellings processes payments through a USD-based credit card processing merchant. Any foreign exchange fees imposed by banks or credit card providers are the responsibility of the customer.
4. SPECIAL & PRE-ORDER PURCHASES
4.1 For pre-order purchases, a 50% deposit is required to confirm the order. Customers must provide a complete address, valid contact email, and telephone number to receive updates.
4.2 Special order merchandise must be paid in full at the time of order confirmation. These items cannot be cancelled, returned, or exchanged, except in cases of manufacturing defects or excessive delays as outlined in 4.3.
4.3 Dwellings will make every effort to fulfill special orders within eight (8) weeks or as otherwise stated. In case of delays exceeding four (4) weeks beyond the original due date, customers may cancel the undelivered items for a refund in the original form of payment.
4.4 Once the item arrives and customers are notified, any remaining balances must be paid within 10 days. Unpaid balances will incur a 1.5% monthly finance charge until settled.
4.5 Customers will have 30 days to collect or arrange delivery after being notified of its availability. After this period, a storage fee of 2.5% of the item's value per month may apply. Delivery will be suspended until storage fees and unpaid balances are settled.
4.6 Merchandise not collected within 60 days will be considered abandoned, and the deposit will be retained.
5. DELIVERY & COLLECTION
5.1 Ownership and risk of loss transfer to the customer upon delivery or collection. Dwellings is not responsible for damage, theft, or loss occurring after this point.
5.2 Delivery charges may apply and will be communicated at the time of purchase. Delivery scheduling will occur after purchase is complete and all delivery related fees have been paid.
5.3 Dwellings reserves the right to deliver merchandise in full or in installments, based on availability. Customers will be notified if this situation occurs and will only be charged once for split deliveries.
5.4 The delivery team will not remove existing furniture, household items, doors, or windows to facilitate delivery. If the delivery is deemed difficult, the customer may be required to sign a damage waiver.
5.5 Dwellings reserves the right to decline delivery if the requested placement location poses significant challenges due to limited access or insufficient space for safe and reasonable manoeuvring of the item(s). In such cases, the delivery fee will be fully refunded.
5.6 Customers must sign a Delivery Completion Form upon receipt of items in good condition.
5.7 If a delivery attempt is made but is unsuccessful, a new delivery date and time will be scheduled, and a redelivery fee may apply.
5.8 If delivery of an item is refused, a 20% restocking fee may apply and delivery fees are non-refundable.
5.9 In general, collection of furniture items is not permitted. However, if authorized, customers must sign a liability waiver for transportation or assembly not handled by Dwellings
5.10 For online orders, items must be collected within 30 days of purchase, or the order will be cancelled, and a 20% restocking fee will be deducted from the refund.
6. RETURNS & EXCHANGES
6.1 Dwellings provides a structured return and exchange policy to ensure fairness and transparency for all customers. Returns or exchanges are subject to the following conditions, including eligibility criteria and timelines. Items that do not meet these requirements may not be accepted for return or exchange.
6.2 The Return & Exchange window begins from the date that the customer becomes in possession of the item.
6.3 Final sale or clearance items are not eligible for return or exchange.
6.4 Items purchased from Dwellings can be returned or exchanged in accordance with the below:
- Within 3 days: Furniture in showroom condition may be returned after delivery but may be subject to a collection and restocking fee of 20% of the value of the item.
- Within 7 days: Unused, unopened items with applicable tags and original packaging may be returned for a full refund, exchange, or store credit.
- Within 30 days: Unused, unopened items with applicable tags and original packaging may be returned for an exchange or store credit only.
7. WARRANTY
7.1 All warranties commence from the date of customer possession.
7.2 Manufacturer warranties printed on packaging or manuals do not apply in Barbados.
7.3 Dwellings provides the following warranties:
- Furniture items: One (1) year manufacturing warranty.
- Small kitchen appliances & Cookware: Six (6) months manufacturing warranty.
- Food Items: Seven (7) days from purchase to report or return any spoilt or expired (on or before date of purchase) for a full refund.
- Mattresses: One (1) year manufacturing warranty.
- Baby Gear: Inclusive of strollers, car seats, playards, bassinets, highchairs, six (6) month manufacturing warrant.
7.4 These warranties exclude the following product categories:
· Linens
· Dinnerware
· Decor
· Seasonal items
· Personal care Items
7.5 Manufacturing defects covered by the warranty include flaws or issues from faulty materials, craftsmanship, or production errors affecting functionality or durability.
7.6 The warranty does not cover:
- Normal wear and tear, cushion softening, and natural fading.
- Fabric changes in color, pilling, or tears from use.
- Damage due to improper use, spills, stains, or pet damage.
- Modifications made after purchase.
- Exposure to extreme environmental conditions.
- Rusting, corrosion, or mold from inadequate maintenance.
- Minor cosmetic inconsistencies in fabric texture or wood grain.
- Self-assembled products not assembled per manufacturer instructions.
- Electrical product damage due to power surges or electrical-related issues.
8. CANCELLATIONS & FRAUD PREVENTION
8.1 Orders cannot be cancelled, modified, or deferred without prior written consent.
8.2 If a cancellation is approved, a fee up to the deposit amount may be charged.
8.3 Special order items are non-cancellable and non-refundable after purchase.
8.4 Dwellings reserves the right to refuse or cancel any order if fraudulent activity is suspected.
8.5 Dwellings reserves the right to request identification information on any orders to validate the purchaser details to avoid the possibility of fraud.
9. GIFT CARDS
9.1 Gift cards issued by Dwellings are non-refundable and cannot be redeemed for cash. They are valid until the expiration date printed on each card and may only be used for purchases at Dwellings Inc, operated stores or online e-commerce platforms. Lost, stolen, or damaged gift cards will not be replaced.
10. GOVERNING LAW & JURISDICTION
10.1 These Terms & Conditions shall be governed by the laws of Barbados. Any disputes shall be resolved within the jurisdiction of the courts of Barbados.
